District Court Distinctions

Almost all Drunk Driving (DUI) charges are handled in District Court as misdemeanors. Only a fourth DUI in five years or some other accompanying felony charge would move a DUI case into circuit court. Each jurisdiction in Northern Kentucky prosecutes their DUI cases in their own manner. For instance, in Campbell County the judges commonly use KAP (Kentucky Alternative Program), a private probationary entity, to supervise those convicted of DUIs, whereas the other jurisdictions do not commonly adopt this practice. Each jurisdiction handles their Discovery process differently. Each judge in each jurisdiction also may have a different method of dealing with DUI convictions. It is very important to hire an attorney who is intimately familiar with each jurisdiction.
